Hello Attorney,
I have 6 months left on my H1B-I797 to expire. My visa on the passport got expired in 2007. I am planning to go to Tijuana, Mexico for stamping. I work for a financial company for past 4 years. I have approved I140.
Can you please advise if i can get the visa stamped? I have to visit India in May and hence cannot wait until the my H1B extension is filed and approved (based on my approved I140).
I am confused and worried that the consular officer may say that you have less than 6 months of validity on I797 and may deny the visa.
Can any one please advise?

In 2002, I left my employer(A) and joined another company(B). New employer applied for my h1b and in 3 months we got an RFE. Coincidentally, I did not like that job and just left that employer(B) to join the previous employer(A).Never tried to get the h1b reciept from. Now that company is folded and there is no information about that company(B). Later that year, company B gave me a W2 for 3 months pay which I had to file later that year.
While applying for 485 in june 2007, in mad rush I had to fill up G-325 form and I did not write anything about working for company(B) for 3 months. Rather I mentioned that I worked for Company A thru 2002.

Thats not an issue looks like. When you go for FP, just ask them to see if your name is correct in the system with you A number. Thats more important thatn the spelling on notice.

I did my Masters and then got a job in Company A who filed my H1b Visa on 10/01/2008 and valid until 07/25/2011.
I did not get stamped yet as i never leave US until now.
Meanwhile my employer applied for amendment as i was put into a project in another state and change in my title .
When i check the status it says "On May 7, 2010, we mailed you a notice that we have approved this I129 PETITION FOR A NONIMMIGRANT WORKER. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283."
I am going to my country on August 2nd week for my marriage and my questions are.
can i use my current I797 for visa stamping or should i use new I129 which i did not get yet?
can i use the notice as the proof of I129 in case they need it for stamping?
Also could somebody please tell me how long will it take to receive my I129 after the above mentioned status?

Some members quoted that they hold a second H-1B. Because these second H-1Bs do not fall under any quota, this is a USCIS given gift for us, considering how slowly they process our applications.

Just want to know my options here and here is my scenario:
I am on H1-B and my 6 years of H1B is going to complete on March so I have almost 1 more year to complete my 6 years of h1-B
Right now, I have my LC and I-140 approved from my present employer.
Now, I am thinking about moving onto a new job where the new employer is ready to start my GC immediately I take the new job.
My question is:
If I take the new job, would I get my new H-1B for 3 years since my I-140 with old employer/current employer is already approved ?
I don't have the copy of my I-140 but I think I can get it.
Also, if I start the transfer to new employer, would I get 3 year H1B or just remaining 1 year out of 6 years ?

Pl. advise what all documents do I need to send to USCIS for extending stay on visitor visa for my parents.From all the sources I read so far here is the list of documents that I feel that needs to included :
1)I-539
2)Letter to USCIS (from me the sponsor) explaining the reason for extending the stay.Please post any letter format that I can use.
3)Copy of parents passport
4)Copy of I-94
5)Copy of original return ticket (with return date in 6 month from 1st entry)
6)$300 fees
Questions :
Do I need to sent I-131
Do I need to send bank statement and recenet paychecks
Do I need to buy new ticket for extended date and send a copy?
This is a last minute decision.I-94 expires in 3 weeks.PLease help .

Reid Eyes Rules Changes To Restrict Amendments (http://www.rollcall.com/issues/53_10/news/19488-1.html) By Emily Pierce, ROLL CALL STAFF, July 23, 2007
After nearly seven months of battling Republican filibusters and controversial amendments on the Senate floor, Majority Leader Harry Reid (D-Nev.) said Friday he may seek to change Senate rules to make it easier to restrict amendments on the floor.
Reid said Rules and Administration Chairwoman Dianne Feinstein (D-Calif.) would be tasked with exploring what rules changes should be made.
Noting that there has been a "growing breakdown between the majority and minority in terms of how to get things done," Howard Gantman, Feinstein's chief of staff for the Rules panel, said the committee would conduct a "comprehensive review" and look at the rules on the germaneness of amendments and how long Senators have to review proposals before voting on them.
"Sen. Feinstein is very serious about looking at the vast range of amendments that are brought in at the last minute that are not germane," said Gantman. He added that the panel's focus would be on "how to better get things done."
Reid spokesman Jim Manley cautioned that Reid "has no intention of unilaterally seeking a rules change."
However, Minority Leader Mitch McConnell (R-Ky.) scoffed at the notion of limiting or restricting Senators' ability to offer amendments, which he likened to freedom of speech.
"Look, nobody's going to shut anybody up in the Senate," he said at a press conference Friday. "There's going to be robust debate. You can just write that down. And I understand Sen. Reid's frustrations, but we're not going to establish any speech police in the Senate - not now, not ever."
Reid apparently reached his boiling point Thursday night when Republicans used Senate budget rules to offer a number of non-germane amendments to a student loan financing bill.
"What went on last night was ridiculous," Reid said on the Senate floor. "We should change those rules. ... We will have to take a look at that."
Reid said Health, Education, Labor and Pensions Chairman Edward Kennedy (D-Mass.) and ranking member Mike Enzi (R-Wyo.) managed the student loan measure "very well until it ran into the rule that we have here that allows unending amendments on any subject forever, literally, before you get to final passage."
Because the higher education bill - by virtue of its status as a budget reconciliation measure - was immune to filibuster, Senate rules permitted unlimited amendments to be offered and voted on. On Thursday night, in particular, Senators were given only a few minutes to review the substance of some amendments before they were asked to vote on them.
As is customary with budget and reconciliation measures, Senators engaged in a long series of back-to-back votes, known as a "vote-a-rama," at the end of the debate. But Democrats said Republicans' insistence on having 14 non-germane votes - including six related to cutting taxes, three related to immigration and two related to terrorism - was excessive.
When Democrats pushed back with their own non-germane amendment expressing the Senate's opinion that President Bush should not pardon Vice President Cheney's former chief of staff, Scooter Libby, Republicans tried to force a vote on former President Bill Clinton's controversial pardons.
But before the Senate could vote on that, Reid asked that both the Libby vote and the GOP pardons amendment be stricken from the Congressional Record, and the chamber voted on final passage of the bill.
Manley explained: "These so-called vote-a-ramas are bad for the system, and they may lead to bad policy. As have leaders in the past, all Sen. Reid was doing was expressing his frustration at the Republicans' desire to score cheap political points at the expense of a good-faith effort to pass a bill that will make college education more affordable for more Americans."

A consultant in my project recently got his visa stamped in India. He didn't faced any issues. They didn't even ask for client letter. I guess he is just lucky :).
I am going to India next month and need to get my visa stamped. I work for a TARP employer ... Lets see how it goes.

Hi,
I am here in US working for a company on L1 Visa. My Visa and I-94 expires on November 2010. The company has already applied for my H1. I am planning for a vacation to India in August. I have the following question,
1. When I comes back to US from my vacation, in September, I dont have to go to the consulate, as my L1 is still valid. And I wont be able to go to the consulate for H1 stamping, as they wouldnt have started the stamping for this year, right?
2. Once I am back in L1, do I have to go back to India for H1 stamping, as my L1 expires in November?
3. Or the best method is to visit India after October and get it stamped with H1 from the consulate while coming back from India?
