The other posters are correct in that they are telling you that your spouse is covered under section 245k. That is as long as a person hasn't overstayed an I-94 card by more then six months; no major criminal or health issues then everything is reset upon leaving and re-entering USA.

However; USCIS officers try to find other ways to nail people when a person needs protections such as 245k.

I have seen a couple of cases where people have had an i-140 denied due to education. They appealed and re-filed another 140 and in the eta 750b they omitted certain education diplomas that were listed in the first application. USCIS then accused them of fraud and a permanent barrier to getting greencard.

Now; it looks like the officer is going down the same road on your husbands case. Accusing your husband of essentially fraud by claiming that he was working with a company listed in the g-325a biographical information when it appears to uscis that he wasn't working with them. 245k or any other part of immigration law which could protect him becomes difficult to use when they accuse you of fraud.

To get a better grasp of things; you need to post the RFE's that he received on his original case (don't post general stuff but be specific) and what they are saying now. It will allow people to help you better assess the situation.

Particularly worried about what you just mentioned about USCIS using other means to deny application - this seems to go against the principle of 245(K) which was to allow folks to get GC irrespective of a violation in the past. If the intent is to not let folks use 245(K), why even publish such a law? MOre importantly, for folks who have been staying and working in a country for many years (read > 5 yrs), it is possible that they might have some glitches and 245(K) was there to cover that (I am not saying every one has gone through this but a lot of people in 2000/01/02 went through this).

What are the grounds for I-485 denial if my I-140 is approved?

The followings are the grounds for an I-485 denial.
    a. Some crimes committed by the applicant.
    b. The applicant is out of status or illegally worked for over 180 days.
    c. If the I-140 is employer-sponsored, the applicant changes job before I-485 has been pending for 180 days.
    d. The applicant drastically changes occupation or job field.
    e. The applicant travels abroad without Advance Parole (H/L visa or status is excepted).
    f. The applicant’s failure to RFE or fingerprint.

You mean the spouse gets 245i benifit even if the spouse was not present here on dec 2000 and came after 2001.

I haven't read the memo in a long time. You would need to research it.

It just piqued my interest because it could be used by people who need the 245i benefit but weren't eligible for it and they got it through their spouse even though spouse may have not needed it and spouse relationship didn't even exist at that time.

Legal base employment candidates never had any representation as far as I know of until Immigration voice was formed. The other groups had some organized activity.

From some of the postings I have seen from IV Core; I believe they know what they are doing. They seem to be getting right advice of when to go on offensive and when to be defensive.

It is difficult for candidates/people who only have five to six years of history in this country to know how the system works here; ie., what arguments work and what arguments don't and what other side will do in ruining your credibility if they are pushed.

Everyone wants their greencard and they try to find reasons which they think others will appreciate (whether they have much merit or not).

    Completely agreed.

If you don't got the greencard, good luck for that. Please don't discuss any religious things here. It make others furious. Concentrate on your carrer and family. Belief in God is enough. Organised Religion will give misery only. Man made the religion. God didn't created it.

you have serious language comprehension issues.. I used bastards on palestinians not jews in a post where i was defending palestinians, so i was being sarcastic
and in the other post you refer to, i was criticizing jews, cristians and muslims for taking the end of time scenarios too seriously and applying it now.. no ones knows we are the the end of times anyway.. and even if that in some way offends you, that doesn't make name-calling all egyptians any less racist

But congress needs to find some solution for H1b mess like applying 150k H1b in one day. If no alternative solution is suggested some part/all part of this bill may be considered. US companies will not be impacted as they are not h1b dependent and they are hiring more than 50% US workers so they may not oppose that much. If Microsoft lobby for 200k H1b but still if they could not get any h1b why will they lobby it? American companies will either ask unlimited H1b or restrictions for bodyshopping so that everyone will get fair share of H1b. Lottery is shame as many deserving candidates will be rejected but many lower grade people may enter there is no merrit in selection of H1b. If IV is opposing this they need to give some solution for H1b mess. Otherwise no point. Also the bill was introduced by both Democrat and Republican. So Whether it is passed or not it is going to be considered

And with a posting like this u think you are higher grade....

Good discussion. I am not a fox fan, but i read NYT and Drudgereport, listen to Rachel Maddaw as well as Handel. In fact i read any political and economics related blog i can lay my hands on. I understand your points.

My point is that people say he will do so many things, the problem is that the congress is not changing. The congress has to approve something so that he can sign it. Secondly no matter what you say companies will do whatever is right for the bottomline and share price. if he starts taxing companies they relocate, he has proposed increasing the social security taxes across all categories. Says he will not increase taxes for middle class americans but gives little indication of how he will finance the trillion dollar spending program. If his universal health program passes then you will see more deducted out of your paycheck. How will he create tons of jobs, how will he subsidize education. The fact of the matter is that he will be under exterme pressure if he is elected to office with such high expectations. He will be screwed if he increases taxes and screwed if he doesnt fund the programs he is promising all over the place.

As for long term, the country has to increase interest rates to support the current account deficit. IF you increase interest rates the economy will further go in the tank. The country has to increase taxes to fund SS or Medicare. If not they need to overhaul the SS and MC system and any pandering politican will never be able to make that change.

The fact of the matter is that both are career politicians and will do anyting to win. i just want to present an opposing view when one is painted as the saviour and the other a @$#@ in a total crapfest where no one is pure.

Just Kidding - reading your post i was feeling like I'm reading a comment from Fox News. However i do respect your opinion and thanks for expressing it.

My Point is more long term - in the shorter term no major change can happen to economy even if Barack wins but eventually Economy would be stronger under Barack's leadership. He also stressed that he would stop "JOBS BEING SHIPPED OVERSEAS" which means companies like TATA or INFY or some Chinese company taking my Job ( or any American's Job ) away from US to INDIA or CHINA. If you are planning a future in US - you would not want your US job taken away by your brother at INDIA or CHINA and Barack will make sure that doesn't happen.

The Bottonline is he will create tons of Jobs at US , so unemployment will be very low , average peoples will be happy and however loud ANTI-IMMIGRANTS scream and shout no AMERICAN will pay attention. Our EB reforms will Pass much easily and we will be able to able to lead a much happier and content life with GREEN CARD.

Once again my Point is definitely Long Term - in the shorter duration Barack has to first fix the Mortgage Mess and do something with Iran by taking help from EUROPE.

I read your replies and it seems you are ignoring some facts and are forming a one sided opinion.

-----------------------Not really; i have much more knowledge on this then everyone on these boards. I'm just hesitant of giving very specific examples as it will give some people more information then they need to know.

    - Why did USCIS allow labor substitutions? Why did it take them so long to stop it? Why did they wait until after July 07 to stop it. Were they not allowing people to use this back door and lawyers to make money?

------------------labor subsitution issues seemed to be confined to a specific industry, specific people. People thought retrogression was going to go away. Did it go away? Main issue with EB is more people then # of greencards available. It may change the ordering but not the number of people going for greencard.

    - If consulting is a problem, what were they doing in the past few years? What are they doing now? Do you think just a few raids once is enough to stop the problem? Why can't they enforce their own laws so that they punish the companies and not the immigrants.

------------------------------------they are your sponsorers. They are the reason why you are here. Without them; you are not here. If they are not following the laws the way uscis wants then they will make it difficult for them. They are going hard after them to directly go after you. Don't you guys understand that?

    - Why is USCIS making paperwork difficult. Why can't the system be simple like Canada or Australia so that we can do our own paperwork? Why are lawyers in the picture?

-----------------------------Those systems are designed becasue they want people there. USA system is not designed for this. Increasingly; it is becoming apparent that uscis/government is becoming hostile towards immigration. Once; they determine they actually want people here then they'll make it easy.

    - If they find problem in consulting, why are they not going after Tata, Wipro etc. Don't tell me these companies are clean?

--------------------------------------who says they are not going after them. they are all getting a healty case of denials. Main issue is they are thinking there is fraud in IT. IT is dominated by people from India. Kill staffing companies; then you kill h-1b.

    - Why is USCIS so disorganized without good IT. Do you think other agencies are also same? Do you think USCIS does not have enough money?

---------------------------------------Problem is that with the myriads of laws and USCIS discretion in following laws; there is no perfect IT system since much of it is related to adjudicator discretion.

    - Why can't they ban DV lottery? But go after H1Bs. You will say to do that law must be changed. But at least go strict on whom you approve once they are selected in the lottery. Are they not bringing lot of criminals, fanatics, unemployed and uneducated poor through DV.

-----------------------no idea. I do see that people talk about "highly skilled". There is no definition of "highly skilled" in immigration. Skilled worker is job that requires two years of experience. I bet just about every person coming through DV or family base would meet the definition of skilled worker in employment base sens.

    - Why can't ICE do their job of enforcement and round up illegals. If they were strict we will not have so many illegals or the problem of illegals.

----------------------who says they are not. It is just a different perspective of what people think they should go after. Right now DOL is visiting consultants at their end client locations and interviewing them.

The questions will go on. But you need to step back and think more from the perspective of a applicant waiting for his GC or H1B .

I was one of you and I mainly deal with many of you guys. Unfortunately, people want to come into this country in many different ways and just because we want to; doesn't mean they are going to let us.

    btw; see --------------------------------for my comments.

violence is a two way sword..

its not that hamas is doing gandhigiri there.. even though they were elected to rule palestine..those morons instead of providing good governence and hope to their ppl..have resorted to some mindless/aimless bombing of Israel.

i care that kids are getting killed... but dont you care then when one of ur jihadi blows himself up..and many innocent get killed.
I support that palestinians be given their right to self rule.. but they should learn to live and let live..

so you are saying.. u can kill ppl in the name of god..and when someone responds..u squirm like a toad?

    grow up.. kid..

Why do you want to end this discussion? Are you scared of speaking the truth or you don't care the killing of innocent school kids?

Dude, you are one confused person.........whats the point here??
EB-3 India is somehow "special" and all you whiners in EB-3 India should get your GCs before EB-2 folks becuase blah blah blah........WHAT???

are you insane?? you make no sense in your argument.

    Numbers fall as EB1--> EB2 --> EB3.

Dont like it, go get an education and/or an EB-2 level job. Else shut up. You have nothing to say.

Duoode chillout, why are you shutting at me? I dont have any beef with you. I am just making my point here. which is, each EB group gets equal quota of 33.33%. And there in no preference or priority given how many visas are issued in the annual quota. The preference is only in the spillover.

Coming to my case, I have Bachelors in Engineering and Masters in Computer scinces form US. My companys HR and Attorney then in 2002 decided and filed my case in EB3 even though I and my Job qualify for EB2 ( I was not working for desi company when I filed my CG, I still work with the same company) my PD is June 2002. I am happy and comfortable in the company, they pay well. Not having CG did not any stop my growth here. I Have no complaints for my situation and I am not blaming any one for my plight and the choices I have made and I stand by with them.

See I am to close to getting my GC so me changing to another company to change to EB2 when everything is working great for me is not a good idea.

Friend Rolling_Flood you take it easy now, no need to get exited.

I have mentioned this point in some other post, I just got confirmation of that and wanted to share with everyone.
I went to one of my friends home yesterday. He has ARM which recently got reset. His rate was 4.3 and this year after reset he got to keep it !! Not only that his monthly installment reduced by $10 , he did not know why !!
So, what we are saying is deadlock here. People who dont have to move will very happy to keep their current loan which will be much cheaper than new loan. Buyers will face not only issue with credit but potentially higher rates. So there are 2 possible scenarios now :
    1. Fed keep fed fund rate same or reduces
As we are seeing, current owners will like to keep their home if possible. Buyers dont see much bargain in current loan rates. So, anyone who has to sell will have to lose much more in price. Home market will be frozen, very bad for economy. The longer the fed keeps status quo, lower the price ...
    2. Fed increases rate
Now ARMS will get reset every year. My friend was surprised when I told him his rate will get reset every year now tied to prime rate. Also, I told him that if not for Fed cuts his rate would have reset to around 7% !! So if Fed raises rate, current owners will suffer. Primes will be new sub-primes !!

In either case, the house prices are going down. The psychology of owning home is changing as equity is not getting build. If no equity, wouldn't I save for my son's college than spend twice the money just to get more space ( and 0 saving in turn).
Wait and watch, be ready for saner prices. 20% drop in home prices from here is very much possible .....

The most likely scenario next year is Republican House and Dem senate with lower seat difference. This is a disaster for any type of immigration. Senate would be only pro-illegal and house against any kind of immigration.
On top of it the only political agenda would be 2012 Presidential election. So 2011-2012 are No-No years for anything good on immigration.
On the other hand you can expect several anti-immigration bills passing with more and more venom in each bill as the clock ticks and enforcement drive firing on all cylinders.

yes its a NO NO for any amnesty...things will get better once skilled immigrants can seprate from the illegal immigrant lobby. Thats what happened in 2000

China’s Political Reformers Strike Back (http://blogs.cfr.org/asia/2011/04/29/china%E2%80%99s-political-reformers-strike-back/) By Elizabeth C. Economy | Council on Foreign Relations

Over the past year, the world has watched with growing dismay as China’s leaders have orchestrated a relentless attack on political and cultural openness in their country. Ai Weiwei. Liu Xiaobo. Teng Biao. Gao Zhisheng. Zuo Xiao Zu Zhou. China has rounded up its artists, writers, lawyers and musicians, releasing some, and then arresting more. The result? The country wounds itself deeply by depriving itself of some of its greatest thinkers, most creative forces, and most determined seekers of justice.

Premier Wen Jiabao, who has begun to sound like a broken record, clearly recognizes this. He once again gently stepped into the fray, stating at a meeting in mid-April, “We must create conditions for people to speak the truth.” Yet this time he has some back-up—and from a rather surprising place: the Chinese Communist Party’s official newspaper, People’s Daily.

A few days ago, People’s Daily ran an editorial with a number of striking statements, including:

“Only in the midst of competition will the value of ideas be shown, and only through practice can they be tested…”
“…it is inevitable that various values and ideas, traditional and modern, foreign and homegrown, will collide and clash.”
“Because we serve the people, if we have faults, we do not fear the people criticizing them and pointing them out…”
“I disapprove of what you say, but I will defend to the death your right to say it.” (quoting Voltaire)
“Seven mouths and eight tongues are not frightening, but most frightening is when not a crow or sparrow can be heard.” (quoting Deng Xiaoping)

What is behind this fresh salvo from the reform flank? Chinese media professionals—particularly ones who have retired—have often been at the forefront of calling for greater political openness. We’ll have to wait to see whether any other media support the People’s Daily or whether the bold editorial staff is simply sacked.

The Chinese frequently, and correctly, remind us that the path of political reform will be decided by the Chinese themselves. The People’s Daily editorial, however, reminds us that the real question is: which Chinese?

send the damn letter, nothing happens, and then come back here and vent your frustration again. as you said, buddy, HARD LUCK indeed !!

I cannot believe the nerve that you EB-3 India guys have. You are begging for a GC based on your length of wait!!! laughable at best...........go wait a decade or so more, then come back here and start this useless BS again.

one good thing happens for the EB-2 folks, and the EB-3 community cannot stomach it. pure freaking jealousy.

Sorry but couldn’t ignore this being an EB3-I applicant with more then 10 yeas in US and 7 years in GC processing. I think most of EB3-I are people who got stuck in this queue (specially during 2001/2002) have a master or more and applied in EB3 based on their employers/lawyers advise (My Case).

I think the quoted poster needs to understand the frustration that builds up with people who have been waiting in line for a long time. I don’t think EB3 is jealous but happy for our fellow country men who got the bright side of this mess.

Good luck and god speed to all.

    Thanks UnitedNations for this discussion.

In the booming years of 99-00 you could see all these consulting companies having a ball. Personally I have seen people with no relevant skill set getting h1's approved in a totally unrelated job profile. I even have come across staffing companies who have hired recruiters as "business analyst's", now its highly unlikely that these companies could not find recruiters here. But the system was getting misused rampantly.
I have had experience with companies who with collusion of someone inside a company
"snagged" portion of revenue from a contract. It wasnt common for 3-4 companies to
act as middleman's ("layers") the final employee who actually worked getting literally
peanuts share of the contract amount. I think this still happens today from what I have heard from my friends.

USCIS had to respond in someway or the other. I am happy that they did but on the other hand I feel sorry for their employees who are probably innocent "collateral damage" victims

It makes me very uneasy as who knows what USCIS will come up with next. The longer our wait is there is a potential for more scrutiny and who knows what pitfall awaits us lurking somewhere where we least expect. Just because people misused the system we are all going to face the consequences.

Stating the obvious: Your attorney was a knucklehead?

USCIS hasn't gone to zero tolerance on 140/485 so it is doubtful that you will get such a query.

    Are you still on H-1b?

If you want to bullet proof yourself then do an eb2 labor now; port the priority date and then inter-file the 485 or file new 485 on eb2 140 which would have been done appropriately. You can get your greencard dependency on the new 140 without losing much in terms of waiting and getting peace of mind.

Thanks UN, I am not in that situation, I was just trying to clarify because I see so many ambiguous explanations related to work location. And By the way, I am on EAD.

Exactly, its about how many people care about the issue. If terrorists kill innocent civilians, first thing they'll say is "Islamic Terrorism". Don't tell me media around the world didn't use this term. Anything and everything blamed on religion and people following the religion.

There is a reason for that. The organizations which claim responsibility for such attacks have names like Jaish-e-Mohammad, Lashkar-e-Taiba, Deccan Mujahiddin... Now I don't have to explain the meanings of their names. Then they say they are doing Jihad!

Why would somebody not call them Islamic terrorists?

Now that does not mean all followers of Islam are Islamic-terrorists.

I am still confused about the whole GC issue in buying and selling a home. Why is GC an issue in owing property or even taking overseas vacations? I have done both with absolutely no issues-caribbeans, europe, India. I have owned a home, and then decided to change jobs-move to a different city and sell my house. Heck I sold my house when I was on vacation in India. I did everything by phone and fax, and this is not some few years ago, this is 2 months ago.
I totally agree with the fact that location and the condition of the house being the key factors. Maybe the fact that I have been here for a few years makes me resident alien for tax purposes helped me? I am not entirely sure.
Folks mentioned that what if you lose your job, and have to leave the country etc. But like I mentioned a house can be sold from abroad. And if you have a GC and you lose ur job, how will you make mortgage payments etc. So some problems will stay the same.
    Any thoughts/comments on my dilema?
Perhaps someone can elaborate on why GC is a factor?
it depends on a persons risk amount - I guess. where did you sell yr house --was it for a loss ? maybe you are lucky to have sold it in last 2 months or something is not correct here.
you can sell the house from abroad - but what if it does nt find a buyer for 6 months ..how do you make the mortgage payments.
for me GC is important - for one - I don't have to worry about status / DHS .
getting a job on GC is easier than on a EAD (u see some threads here already). on GC you can get a job is another field / part - time..without worrying about DHS / DL ..from abroad, I guess you give everything to a RE agent ..I can come up with tons of issues with it (but I know you will come up with counter explanations - so I won't bother). BTW I hope you are not a realtor right ?? some of desperate realtors do anything to convince people nowadays ..the latest I heard was telling me to buy before Hillary comes to white house ..with a mumbo jumbo explanation

Moving fast: Tech lobbyist races to results (http://thehill.com/business--lobby/moving-fast-tech-lobbyist-races-to-results-2007-12-11.html) By Kevin Bogardus | The Hill, December 11, 2007

I really dont have a strong partisan style. I just like getting things done, said Hellmann.

Under his helm, the lobbying team at the Information Technology Industry Council (ITI) has earned a reputation as a smart and aggressive advocate on Capitol Hill for the high-tech cause.

Hellmann, 46, joined ITI in 2001 after several years advising House Republican leaders, including then-House Speaker Dennis Hastert (R-Ill.). But politics was not always foremost on the Florida natives mind. He describes himself as a former beach bum who did not vote in the 1980 presidential election because he could not choose between Ronald Reagan and Jimmy Carter.

Now I know better, Hellmann said.

By college, Hellmanns interest in Washington had begun to simmer. He majored in political science and says he typically flipped to C-SPAN instead of MTV. In 1984, he took a job as a paid intern to then-Rep. Buddy MacKay (D-Fla.).

Hellmann soon after switched sides and began to move up the ranks. He worked for several prominent GOP lawmakers, such as Rep. Newt Gingrich (Ga.), before becoming a key adviser to party leadership. There, Hellmann helped to push through welfare reform, anti-poverty legislation and the No Child Left Behind Act.

The lobbyist always strived for results in Congress and saw the need for both parties to work together. Hellmann put that philosophy into practice as the liaison between then-House Majority Whip Tom DeLay (R-Texas) and the coalition of Blue Dog Democrats.

He knows substance, but even more importantly, he knows the institutional quirks and the process as well as anybody in town, said Rep. Adam Putman (Fla.), the House Republican Conference chairman. Putnam credits Hellmann with educating members on how the technology sector is a driver of the economy.

As ITIs senior vice president of government relations, Hellmann says it is not difficult to lobby for his trade groups members corporations like Dell and eBay since they are the coolest companies in the world.

We call it the wow effect, said Hellmann. But gone are the days when high-powered executives for tech companies could fly into Washington once a year, meet with lawmakers and expect to achieve what they wanted on Capitol Hill, according to the lobbyist. Now, a daily, active presence is necessary to keep check on Congress, which can affect the industry on multiple fronts.

Increasingly, other well-heeled business lobbies with decades of experience in Washington are weighing in against tech companies interests. We have to match them in shoe leather, said Hellmann.

Adam Kovacevich, Googles Washington spokesman, described Hellmann as an excellent advocate for the tech cause a good consensus-builder who has a great understanding of what is actually possible on the Hill.

He has never stopped building relationships with new generations of staff, said Kovacevich, who worked at ITI in 2005.

To maintain ITIs lobbying prowess, the trade group executive has helped assemble a team of type-A personalities who can work with both parties and understand how Congress works. Each lobbyist has between five and 10 years of government service, Hellmann estimated.

With Rahm, we moved a million miles a minute and we got things done. I felt ITI worked the same way, said Jon Hoganson, who recently joined ITI from House Democratic Caucus Chairman Rahm Emmanuels (Ill.) office. It wasnt about white papers and setting up meetings.

Hellmann credits ITIs quick action with helping to convince Congress to set a date for the country to move from analog to digital television. The trade group and its member companies formed the DTV Coalition, and stressed in Hill meetings that the sale of spectrum bandwidth could generate $10 billion in federal revenue, according to Congressional Budget Office estimates.

More recently, ITI has waded into the emotional battle over immigration. Hellmanns German-born parents came to America in 1956 on his fathers employment visa, so the debate has special resonance for the lobbyist.

There is a strong nativist element in Washington right now, said Hellmann. Republicans have weighed in against immigration reform.

Democrats, meanwhile, have railed against trade deals, another ITI priority.

With so much on the trade groups plate, Hellmann plans to keep ITI up to date on Washingtons happenings and sees no need to slow down.

Politics is a fast-moving sport, Hellmann said.

A guy in a bar was talking about how he always watched his wedding video backwards.

    When asked why, he replied:

"Coz I love the end bit where she takes the ring off her finger, goes back down the aisle, and jumps in the car and disappears..."
